Zoning Board of Appeals

The Zoning Board of Appeals is directly given appellate jurisdiction by State law. Appellate jurisdiction is the power to hear and decide appeals from decision of those officials charged with the administration and enforcement of the zoning ordinance of local law. The primary function and purpose of the Zoning Board of Appeals is zoning administration including the power to interpret the zoning ordinance or local law and to grant variances.

The Town of Big Flats Zoning Board of Appeals interprets the Town of Big Flats Municipal Code – Title 17, Zoning.

Applying to the Zoning Board of Appeals

The applicant must contact the Planning Department to first determine if a variance is necessary. If a variance is necessary, the Planning Department will provide the applicant with the necessary documentation. The completed application and fees must be submitted to the Planning Department.

The application is automatically scheduled for a Planning Board meeting at least thirty days (30) prior to the scheduled hearing date to the Zoning Board of Appeals. Once a recommendation is made by the Planning Board, the application and applicable documentation is submitted to the Zoning Board of Appeals. A public hearing will be scheduled and a legal notice advertising the public hearing must be published at least five (5) days prior to the hearing date.
